Application to Review a Development Application

When do you need to do this?

1.    Review of a Determination

Review applications don’t apply to all types of determinations. Review applications don’t apply to complying development, designated development, integrated development or a determination made about Crown land applications. A review of a determination made by the Local Planning Panel or Regional Planning Panel are required to be referred back to the relevant decision-making body.

There are deadlines for appeal applications to be made and determined from the date of the original decision:

•    Review of a development application determination: Council must be given adequate time to determine the review within 6 months from the date of the determination.  It’s recommended you lodge the application within 3 months of the determination date to allow time for the review to be made.

•    Review of a modification determination: Application must be lodged within 28 days from the date of the determination. We recommend review applications be lodged as soon as possible to allow a determination to be made in time.

2.    Review of a Decision (rejected applications)

A rejected application must be processed by Council within 14 days of lodgement of the application (ie. once all legislated fees are paid).  

A review of a decision to reject a development application must be made no later than 14 days after the applicant is given written notice by the Council of its decision to reject and not to determine the development application.

Council will then carry out the requested review and provide a decision within the following 14 days. There are no further appeals rights should a rejected application not be successful.

•    plans and other information relevant to the review 
•    owners consent

2.    Lodge your review application

All review applications must be made through the NSW Planning Portal.

Council will not accept applications by email, in person or by post.
